Audish v. Macias: Attacking Plaintiff’s Future Medical Expense Claims

In Audish v. Macias (2024) 102 Cal.App.5th 740, the 4th Appellate District in California decided a key issue concerning the admissibility of plaintiffs’ future health insurance / Medicare eligibility in calculating damages regarding future medical expense claims. This decision has significant implications for how future medical expenses are assessed in tort cases, notably as related to a plaintiff’s life care plan. The Court built on the foundation provided by the California Supreme Court in Howell v. Hamilton Meats & Provisions, Inc. (2011) is 52 Cal.4th 541 and found that evidence concerning a plaintiff’s eligibility for future benefits, such as Medicare, is not barred under the “collateral source” rule.
