This program will address the application of arbitration discovery rules under JAMS, FAA, and State and Federal law from the standpoint of both the practitioner and arbitrator. The scope of permissible discovery under these rules will be addressed, including hearing and pre-hearing discovery; preparing in advance for discovery; proportionality and the limitations involving nonparty discovery. The program will consider the scope of the arbitrator’s authority to determine arbitration discovery disputes, and the role of the arbitrator in seeking proportionality and cost-effectiveness in the discovery process.
