As the number of traditional product manufacturer and supplier companies sued in the asbestos litigation dwindles, plaintiffs have become increasingly creative in their search for new sources of potential compensation. Plaintiffs are now including talc and talcum powder exposures as an alleged cause of mesothelioma and other asbestos-related diseases, and are increasingly suing the manufacturers, sellers and suppliers of raw talc and cosmetic talcum powder products in the litigation. This presentation will cover the nature of talc products, the potential for asbestos contamination, the epidemiologic studies of exposures to talc and talc products, and the evolving response of government and industry to the contamination issue from the late 1960s to the present. There will also be a discussion of how these cases have been presented by plaintiffs and defended by defendants at trial.

The decision in Davis v. Honeywell has created a great challenge to defendants in asbestos litigation, as the trial courts have been given a pass on resolving scientific controversies when ruling on the admissibility of expert testimony regarding the "every exposure" theory. Is there a way for defendants to prevent the introduction of junk science to a jury? This presentation will provide insight into litigation strategies to limit the consequences of Davis v. Honeywell, and to encourage judges to invoke Sargon and serve as a gatekeeper to prevent unsound expert opinions from being introduced at trial.
